Our modern law traces its roots back to Magna Carta in 1215, which provided the first attempt by Western Civilization to make laws consistent and fair. That was a long time ago, and many changes have occurred. In this past year, we had the first Supreme Court decision as to the meaning of the Second Amendment right to bear arms. Across the country, there is emerging law about same sex marriage. Federal funds have been distributed, and often come with a requirement to change the terms of contracts already entered into between people. Is that fair? These and other current legal issues will be discussed. Nothing in this talk can be considered to be legal advice, but merely the observations and options of Jerome J. Ghigliotti, Jr., Esq.

Joseph P. Tomain, Dean Emeritus and the Wilbert & Helen Ziegler Professor of Law will discuss his book – Creon’s Ghost: Law, Justice, and the Humanities. In the Western Tradition, one of the many ancient questions that go unanswered, or at least go without a final answer, is: What is the relationship between law and justice? The question can also be framed as: What is the relationship between law and morality? Most discussions of these questions, certainly discussions since post-World War II Nuremberg, involve distinctions between natural law and legal positivism. Natural law holds that law is necessarily connected to justice or morality and legal positivism maintains their separation. Creon’s Ghost explores both of these responses and adds a third with stories from the humanities and with contemporary legal examples such as the death penalty, gay marriage, and religious symbols in public places.
